Preamble
These Terms & Conditions (the “Terms”) govern purchases made via https://outseam.shop (the “Website”).
Outseam operates the online store available at https://outseam.shop.
Business address: Rua Aval de Baixo 238, 2.1, 4200-103 Porto, Portugal.
By placing an order, the customer (the “Customer”) agrees to be bound by these Terms.
Article 1 — Scope of Application
These Terms apply to all purchases made through the Website.
These Terms constitute the entire agreement between Outseam and the Customer and supersede any prior representations, communications, or agreements.
Outseam may amend these Terms at any time. The version in force at the time the order is placed applies to that order.
Article 2 — Registration & Account
Registration is not generally required to browse the Website. Registration may be required for certain features or promotional periods.
Outseam may approve, reject, suspend, or terminate any account at its discretion.
The Customer is responsible for maintaining the confidentiality of login credentials. Any activity performed through the Customer’s account is deemed performed by the account holder.
Article 3 — Products
Product descriptions and images are provided for information purposes and are presented with the greatest possible accuracy.
Minor variations in color, texture, packaging, or appearance may occur and do not constitute a defect.
Products are offered while stocks last.
Article 4 — Prices
All prices are shown in EUR (€) and include applicable taxes.
Shipping costs are not included unless explicitly stated and are calculated at checkout.
Outseam may change prices at any time. The price charged is the price displayed at the time the order is placed.
Article 5 — Order Process
Orders may only be placed via the Website.
The Customer confirms they have legal capacity to place an order and are at least 18 years old or otherwise legally authorized to purchase.
The Customer confirms the payment method used belongs to them and has sufficient funds/authorization.
Data recorded by Outseam (including order confirmations, emails, payment confirmations, carrier updates, and system logs) constitutes evidence of transactions.
An order becomes binding once payment is confirmed and an order confirmation email is sent.
Once confirmed, orders cannot be modified or cancelled prior to shipment, except where required by applicable law.
Article 6 — Payment Terms
Payment is made by the methods made available at checkout via secure payment systems.
Orders are processed only after payment authorization and subject to product availability.
Outseam may refuse, cancel, or limit any order in case of payment issues, unresolved disputes, suspected fraud, or abuse.
Article 7 — Payment Security
The Website uses SSL (Secure Socket Layer) encryption.
Outseam does not store sensitive payment data. Payment details are processed by authorized payment service providers.
Article 8 — Product Availability
If a product becomes unavailable after purchase, the Customer will be informed without undue delay.
Outseam may offer a replacement. If replacement is not possible, a refund will be issued using the original method of payment.
Article 9 — Delivery Conditions
Orders are shipped primarily from Portugal.
Indicative delivery times (not guaranteed):
- Standard delivery: 1–3 weeks
- Express delivery: 3–7 days
- Postal delivery: 1–3 days
Delivery is made to the address provided at checkout. The Customer is responsible for providing complete and accurate delivery information.
If delivery fails due to Customer-related reasons (including incorrect address, refusal, failure to collect, or unpaid customs duties), Outseam may deduct incurred costs from any refund. Reshipment, if requested, is at the Customer’s expense.
Risk of loss or damage passes to the Customer upon delivery.
Where reasonably possible, the Customer should report damaged or incomplete deliveries promptly and preferably within 48 hours, with photos. This does not affect statutory rights.
Customs Duties
Outseam is not responsible for customs duties, taxes, or import charges. These are borne by the Customer.
Article 10 — Right of Withdrawal, Returns & Refunds
Where applicable (including for eligible consumers in the European Union), the Customer may have a statutory right of withdrawal within 14 days from receipt of goods, subject to legal exceptions (including for certain personalized or hygiene-sensitive goods where permitted by law).
All conditions, instructions, timelines, cost allocation for return shipping, inspection standards, and refund processing rules are governed by, and must be followed in accordance with, the Refund Policy available here:
In case of conflict between these Terms and the Refund Policy, the Refund Policy prevails with respect to returns, refunds, and withdrawal procedures, without prejudice to applicable mandatory law.

Article 11 — Warranty & Liability
Products must conform to applicable consumer protection laws.
In case of defects, the Customer may request remedies available under applicable law (which may include repair, replacement, price reduction, or refund, depending on the circumstances).
The warranty does not cover damage caused by misuse, improper care, normal wear and tear, washing contrary to instructions, alterations, or external causes.
Outseam is not liable for indirect, incidental, or consequential damages to the extent permitted by law.
To the extent permitted by law, liability is limited to the value of the ordered products.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Article 12 — Intellectual Property
All content on the Website (texts, images, logos, designs, graphics, videos) is protected by applicable intellectual property laws and remains the property of Outseam or its partners.
Any reproduction, distribution, or use without prior written consent is prohibited.
Article 13 — Personal Data & Privacy
Outseam processes personal data in accordance with applicable data protection laws, including the GDPR.
Data may be processed for order fulfillment, payments, customer support, accounting, fraud prevention, and marketing where consent is provided.
Customers have rights of access, rectification, erasure, restriction, portability, and objection.

Article 14 — Force Majeure
Outseam is not liable for delay or failure to perform obligations due to events beyond its reasonable control, including natural disasters, strikes, carrier disruptions, supply chain disruptions, customs delays, or governmental actions.
Article 15 — Disputes, Chargebacks & Fraud Prevention
Outseam may refuse, cancel, or limit orders and/or suspend accounts in cases of suspected fraud, abuse of rights, excessive returns, chargeback abuse, or bad faith conduct.
Before initiating a payment dispute/chargeback, the Customer should contact Outseam at mail@outseam.shop and provide relevant order details to allow Outseam to review and, where applicable, resolve the issue.
If a chargeback is initiated while a return/refund process is pending, Outseam may suspend processing outside of mandatory legal obligations until the payment dispute is resolved, to the extent permitted by law.
In case of an unjustified chargeback, Outseam reserves the right to pursue recovery of the amounts due, including reasonable administrative and processing costs, to the extent permitted by law.
Article 16 — Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Article 17 — Governing Law & Jurisdiction
These Terms are governed by Portuguese law, without prejudice to mandatory consumer protection laws of the Customer’s country of residence.
Consumers may bring claims before the courts of their country of residence.
Disputes may also be submitted to alternative dispute resolution bodies (RAL) recognized in Portugal.
